The service and who provides it

kuody.com makes QR codes, their short links and the pages they open, and shows you how they are scanned. It is operated by Belbrd LLC, registration number 2022-001093471, a limited liability company organized in Wyoming, United States, at 312 W 2nd St, Unit A879, Casper, WY 82601.

In these terms “we” is the operator of the service, and “you” is whoever opens the account and whoever works in it.

Accepting the terms

If you open an account you have accepted these terms. If you open it for a shop or a company, you confirm that you may accept them on its behalf.

You must be at least 18 years old, or of full legal age where you live, to open an account. You may not use kuody.com where the law of the United States forbids us to provide it: in a country, or for a person or an organization, that it has placed under sanctions.

Making a static code on the home page and using the free tools need no account; of these terms, the section “What is not allowed” applies to them.

Your account

  • You open the account with an e-mail address that you read yourself. The link to reset your password goes there, and so do notices about your account.
  • Keep your password to yourself. The people you invite to your organization work in it under their own name and their own account.
  • You are responsible for the codes and pages made from your account, and for those made by the people you invited.
  • If you think somebody entered your account without your leave, change your password and tell us.

Plans and limits

The free plan is free for ever, not for a trial period: it holds 3 codes that are editable, unlimited scans, and no ads. A code that is static from its first day does not count towards that number; static codes kept in an account have a high ceiling of their own.

A plan's limit prevents adding more, and above it editing stops. It deletes nothing. What happens to the codes above a plan once it has ended is under “What happens if you stop paying?”. The numbers and the prices are on the pricing page.

A plan is your account's and covers all its businesses, whose limits it shares between them; each plan says how many businesses it holds. Only the account holder changes the plan and pays for it, and whoever works in one of your account's businesses works within its plan.

A paid plan is a subscription that you pay for in advance and that renews by itself. Its rules are under “Payment, renewal and refunds”, and you see them again before you pay anything.

Payment, renewal and refunds

These are the rules of a subscription to a paid plan, in the words the pricing page and the page before payment use too:

Who takes the payment
You pay on a page of Stripe, a payment company, which sells the subscription through its service Link: it takes the payment, sends you the receipt and the invoice, and answers questions about a charge. The charge appears on your statement under the name LINK.COM. Your card details go to Stripe and never reach us: we hold no card number.
The price
A plan is paid for in advance, by the month or by the year. The price on the pricing page is what you pay: where your country has a tax on it, the tax is included in that price. The payment page may show the amount in your own currency. If you have a discount code, you type it before you pay, and the page says what it takes off, for how long and what you pay now; after that the subscription renews at its full price. A discount may also be given without a code, as a sale or as an offer for your organization. One discount applies per purchase: discounts cannot be combined.
Renewal
The subscription renews by itself at the end of each month or year, for the same period and at the same price, and your card is charged that day. Before a yearly renewal you are reminded by e-mail.
Cancelling
You cancel at any time from your account's plan page, in one step and without writing to us. The plan stays until the end of the period you paid for, and is not renewed. What happens after that is under “If you stop paying”.
Changing plan
A change of plan takes effect at once. For a higher plan you pay the difference for what is left of the period. For a lower plan, what is left of what you paid stays as credit and is taken off your next payments.
A payment that fails
If a renewal cannot be charged, the card is tried again for 14 days, and you are told by e-mail. Your plan stays during that time. If the payment still fails, the subscription ends, and “If you stop paying” applies from that day.
Refunds
The first payment of a subscription is returned in full if you ask within 14 days of it in a support ticket. This refund is given once: once your account has had a payment returned, the first payment of a new subscription is not. The subscription ends the day the payment is returned, and the editable codes the free plan does not cover are paused that same day, without the days that follow the end of a subscription: those days come with a period paid for and kept. Later payments, renewals among them, are not returned, and cancelling does not return what is left of a period. Where the law of your country, or the seller's own rules, give you more than this, you have it.

What happens if you stop paying?

This is what happens when your subscription to a paid plan ends or you cancel it, as the pricing page also says:

Your printed codes
Every static code, and the editable codes the free plan covers, keep working for good. The other editable codes keep working for 90 days after the subscription ends. Then they are paused: their links show a neutral page until a plan covers them again, and they work again that same day. Each code gets these days once: if you come back and stop again before you have stayed within your plan for 90 days, it carries on with the days it had left, and may be paused the day the subscription ends. A subscription whose first payment was returned gives no such days: the codes beyond the free plan are paused the day the payment is returned. Billing adds no ad and no page in between to a code that works, and no line to what you made while you were subscribed.
Editing
You choose 3 codes that stay editable: those are the codes the free plan covers, the ones that never stop. You may change the choice after 30 days. The rest are read-only until you come back.
We tell you
By e-mail: when the subscription ends, with the day of the pause; again 30 days and 7 days before that day, when there is time; and on the day itself.
Statistics
Codes that work are counted as before; a paused code's scans are not. Nothing is lost because of the plan. You see scan counts, and the details are there again when you come back. Scan details are kept for the period the privacy notice gives.
New codes and the plan's tools
They stop. What the tools already made stays, and its codes follow the rule above. Anything waiting for a step from you waits for your return: a code printed ahead whose destination is not set yet, and form notifications.
Deletion
Nothing is deleted because of billing, or because it is not used. Only you can delete your code.
The exception
A code used for fraud or against the terms, or whose destination is on the lists of harmful links, is disabled, and a neutral page is shown in its place. So are the codes of an organization that was suspended as a whole.

Your printed codes

A static code holds its content in its pattern: nothing we do can stop it. An editable code you have printed keeps working while a plan covers it, and the free plan covers 3 codes for good. We put no advertisement between the scan and its destination, and no page in between except a warning when a site's name is in letters that are not Latin, or while our team reviews a report about the code.

A code stops in these cases only:

  • you pause or delete it;
  • no plan covers it any more: your subscription ended, or you moved to a plan that covers fewer editable codes. It then keeps working for 90 days (not when the subscription ended because its first payment was returned: it is paused that day), and after that it is paused until a plan covers it again. Nothing is deleted, and “What happens if you stop paying?” above says the rest;
  • it breaks these terms or the law, or its destination is on the lists of harmful links;
  • your whole organization is suspended for a repeated or a serious breach;
  • the law requires it of us, or an event outside our control prevents it;
  • the service itself ends. We would then write to you at least 12 months before, so that you can move your codes and reprint what you must.

What is not allowed

Do not use kuody.com for any of the following:

  • fraud and impersonation, including pages that ask for sign-in or card details that are not theirs to ask for;
  • spreading malware or sending people to it;
  • anything unlawful where you operate or where the people who scan your codes are;
  • hiding the real destination behind a chain of link shorteners;
  • uploading logos, pictures or files you have no right to use;
  • spam, loading the service so that it fails for others, or trying to reach what is not yours.

What we do when the terms are broken

Every editable code's destination is checked automatically when it is saved and afterwards, and anybody can report a code from the page we host for it, or on the report page.

A code that breaks these terms is disabled, and a neutral page is shown in its place. If it happens again, or the breach is serious, the whole organization is suspended. We tell you why, and you may ask for a review of the decision from the code's own page.

We may also disable a code, suspend an organization or refuse the service where the law requires it of us, or where it is needed to protect the service or other people.

If you believe something on kuody.com copies your work without your leave, write to us at [email protected] and say what the work is, where it appears on kuody.com and how to reach you. We remove what infringes, and close the accounts of those who do it again.

Your content

What you upload and write stays yours. You allow us to host it and show it to the people who scan your codes, because that is how the service works, and we use it for nothing else. You confirm that you have the right to use what you upload.

Claims made because of your use

You are responsible for where your codes lead and for what your pages say and collect. If somebody makes a claim against us because of your content, your codes or your pages, or because you broke these terms or the law, you bear what that claim costs us, including reasonable legal fees.

We do not review, and are not responsible for, the sites and services that codes lead to, yours or anybody else's, nor for the services of other companies that the service works with, such as the payment company.

Privacy and your visitors' data

The privacy notice says what we record about you and about the people who scan your codes, where it is stored and for how long.

You decide where your codes lead and who sees their statistics. If you add measurement or advertising tools to your pages, or collect your visitors' details with a form, what the law requires of you towards them is yours to do.

The service as it is

We work to keep the service available and your codes working, and we keep backups, but we do not promise that it will be free of interruptions, errors or loss of data. We may change it, add to it or end any part of it; we aim not to remove what your printed codes rely on.

The service is provided as it is and as it is available. As far as the law allows, we give no warranty of any kind, express or implied, including that it is fit for a particular purpose, of merchantable quality, or free of infringement.

As far as the law allows: we are not liable for indirect, incidental, special or consequential loss, nor for lost profit, revenue, data or goodwill, nor for the cost of reprinting or replacing printed material, whatever the cause and even if we were told it could happen; and our total liability to you for everything connected with the service does not exceed what you paid us in the twelve months before the claim arose, or one hundred US dollars if that is more. We are not liable for what events outside our reasonable control cause.

Some laws do not allow some of these limits. Where that is so for you, they apply to you as far as that law allows and no further.

Ending the account

You can download your data at any time from your account page, and delete your account there. If you are the only owner of your organization, make somebody else an owner first, or ask for the whole organization to be deleted, which we approve.

A code you delete stops at once and stays in the trash for 30 days: restored within that time it works again, and after it the code is deleted for good.

We do not close an account because it is not used. We close one that breaks these terms, as “What we do when the terms are broken” says.

What these terms say about claims, liability, governing law and disputes stays in force after an account ends.

Changes to these terms

The owner of the service may change these terms and conditions at any time and without prior notice. The version in force is the one published on this page, with its date, and it applies from the day it is published.

Every version has its date, and we keep the version you accepted and when you accepted it. If the terms change, we show you the new version the next time you sign in and ask you to accept it to go on using your account.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its rules on conflicts of law. A dispute that we do not settle with you directly is heard only by the state or federal courts located in Wyoming, and you and we accept their jurisdiction. If you are a consumer, this takes away none of the rights that the law of the country you live in gives you and that an agreement cannot take away.

As far as the law allows: a claim about the service is brought within one year of the day it arose, or not at all; it is brought by you or by us alone, not as part of a class or a group action; and you and we give up trial by jury.

Before any proceedings, write to us: we want to settle a disagreement with you directly.

General

These terms, with the privacy notice, are the whole agreement between you and us about the service. If a court finds a part of them invalid, the rest stands. If we do not enforce a term at one time, we may still enforce it later. You may not hand your account or these terms over to somebody else without our agreement; we may hand ours over to whoever takes over the service.

These terms are published in Arabic and in English. If the two differ, the English text governs.
